1 – GENERAL TERMS AND CONDITIONS OF SALE –
These Terms and Conditions of Sale govern the purchase agreement between "Stage Deck srls" – hereinafter referred to as the "Seller" – and the customer regarding the purchase of products published on the website www.stagedeck.comt. By electronically confirming the ORDER SUMMARY, the customer declares that they are aware of and unconditionally accept the General Terms and Conditions of Sale and that they will fulfill all the obligations set out therein towards the Seller. For this reason, the Customer is required to carefully review them, print them, and keep them, in accordance with the provisions of Articles 50 et seq. of Legislative Decree 206/05. The Seller reserves the right to modify or supplement these general terms and conditions of sale at any time, including in light of any regulatory changes, without prior notice. Such changes shall be binding on customers only from the moment they are published on the website www.stagedeck.com, and shall not have retroactive effect.

2 – ORDERS –
Once the Seller has received the order sent by the customer, it will send an ORDER SUMMARY by email, specifying all the relevant details. The order will only be considered finalized and completed upon receipt by the Seller of the payment due
Any additional shipping costs that may be incurred due to insufficient information will be borne entirely by the customer.
The Seller will not be able to process orders for products that are no longer available at the time of ordering. In this case, the order will not be processed and the reasons will be communicated by email.
In this case, the purchase contract will not be concluded and the Seller will refund the customer any amounts paid in relation to the uncompleted purchase contract.
The Customer shall have no right to claim compensation for damages or any liability for direct or indirect damage to persons or property caused by the non-acceptance of an order, even if only partial.

3 – PRICES –
The price shown on each model includes VAT.
For customers residing in EEC countries who have an international VAT number, the sale price will be reduced by the Italian VAT rate in effect on the date of the order.

For customers residing in non-EEC countries, the published sale price is to be considered exclusive of VAT or subject to specific regulations.


4 – FINISHES –
The colors, coatings, and finishes shown on the website are indicative, as it is technically impossible to ensure absolute fidelity to the original colors. This does not constitute grounds for contesting the product.

5 – SHIPPING –
Shipping times vary depending on the products and finishes chosen.
Shipping times are indicative, therefore no responsibility can be attributed to the Seller for early or delayed shipping, as these are causes not directly attributable to it. The goods are shipped to the destination indicated by the customer on the ORDER. Periods of absence from the address indicated or other information useful for delivery must be communicated in the order notes field, in order to avoid unnecessary storage costs, which will in any case be borne by the recipient. (See ART. 2 – ORDERS)

6 – TRANSPORT –
The goods are shipped to the destination indicated by the customer and reported on the ORDER” by National and International Couriers, adequately packaged and complete with transport document or accompanying invoice. The relative cost will be calculated automatically at the time of purchase after specifying the relative destination. This service always refers to goods delivered: ground floor, truck tail lift at the customer's street address.
The following services and destinations will incur an additional cost, which will be communicated subsequently by email by the Seller and which will in any case be borne by the customer, adding to the cost already indicated in the order:
– deliveries to floors/basements; deliveries to historic centers or addresses not accessible by 12-meter trucks; express, urgent, mandatory deliveries, with appointment, special deliveries.
– deliveries to disadvantaged areas; inaccessible areas; smaller islands, Venice, and the Lagoon.
Goods travel at the risk and peril of the customer, even if sold carriage paid. No complaints will be accepted after 8 days from receipt of the goods.
It fulfills the obligations set forth in Article 62, paragraph 1, of Decree Law No. 1 of January 24, 2012, converted with amendments by Law No. 27 of March 24, 2012, except for specific contracts entered into between the parties. The duration expires with this supply. For any dispute, the competent court is the Court of Milan.

7 – PAYMENT –
Payment for the goods ordered can be made in the following ways:

  1. a) at the time of ordering, by credit card and PayPal, the most secure online payment system. The credit card will be charged at the same time as the online transaction is completed. If the order is not accepted, the Seller will refund the amount by reversing the transaction through the credit card interbank circuit. The Seller reserves the right to request additional information and documentation from the Customer to prove ownership of the credit card used. In the absence of this required documentation, the Seller reserves the right not to accept the order.
  2. b) by bank transfer in advance to be made upon receipt of the ORDER. All the details required to make the transfer are provided on the final page of the purchase procedure. The reason for the transfer must include the order number and the details of the person placing the order. Any discrepancies between the details provided by the Customer when placing the order and the details entered on the transfer may cause delays in the acceptance of the order by the Seller.


8 – DELIVERY OF GOODS – CHECKING –

Upon delivery of the goods, before signing the waybill that the delivery operator will ask you to sign, the Customer is required to check:
– that the number of packages delivered corresponds to that indicated in the transport document. In case of discrepancy, accept the goods anyway and indicate in detail on the waybill the number of packages actually received. Such discrepancy must be communicated immediately by email to the Seller.
– that the packaging is intact (not wet, punctured, folded, or otherwise damaged) and unaltered, including the sealing tape.
In the event of obvious breakage, damage, or tampering with the packaging, the customer must write on the waybill, in detail, SPECIFIC RESERVATION OF THE GOODS DUE TO DAMAGED PACKAGES RECEIVED, and immediately notify the Seller by email.

In the event of obvious damage to products that have not yet been collected, the customer may refuse delivery, indicating the reason for non-collection on the waybill and immediately notifying the Seller by email.

In order to protect against hidden damage caused during transport, it is always advisable to write "GOODS ACCEPTED SUBJECT TO INSPECTION" on the delivery note, even if the packaging appears intact and undamaged. Any hidden damage found must be reported to the Seller within 5 days of receipt of the goods by registered letter with return receipt. (see paragraph 10 RIGHT OF REPLACEMENT FOR DAMAGE CAUSED BY TRANSPORT)

PLEASE NOTE: if the customer accepts the goods and signs the waybill without making the necessary reservations, they will not be able to claim for any missing items or damage, as the signature constitutes verification and acceptance of the conformity of the product.

9 – STORAGE –
In the event of non-delivery, the goods will remain in storage at the customer's disposal for a maximum of five calendar days, after which they will be returned to the sender. The Seller shall not, for any reason, bear any storage costs for the goods or any costs relating to their return, which shall be borne entirely by the customer. To this end, the customer must specify all the information requested by the Seller on the PURCHASE ORDER form in order to avoid this unnecessary increase in costs.

10 – RIGHT OF REPLACEMENT FOR DAMAGE CAUSED BY TRANSPORT –
To exercise this right, the customer must send an email to info@stagedeck.it within 5 (five) days of receiving the goods, indicating the transport document or invoice number, code, and quantity of the defective items with details of the defect found. The Seller may ask the Customer to send, by email, any digital photos showing the damage claimed. Once the responsibility for the damage has been established, the Seller will notify the customer, by email, of the acceptance of the replacement with the details of the collection by the Courier. The goods must be returned to the Seller using the same courier and in the original packaging, carefully sealed and with the return address indicated on the package.
If this does not happen, the Seller may refuse collection and therefore replacement of the goods.
All transport costs for replacement, both for the return of the damaged goods and for the replacement, shall be borne by the Seller. The goods will be replaced as soon as possible. Any reports received after the above deadlines will not be taken into consideration.

11 – CONSUMER WARRANTY –
Consumers are entitled to the rights provided for in Legislative Decree No. 24 of February 2, 2002. Products are guaranteed against conformity defects for two years from delivery.
The Seller guarantees that the goods sold comply with the declared characteristics and are suitable for the use for which the item is intended. Any faults or defects in the product delivered with respect to what was agreed must be reported by the customer, under penalty of forfeiture, within 30 days of discovery of the fault. The action is time-barred within six months of discovery.
The deadline for reporting apparent defects and/or faults in the goods starts from the day of delivery of the products.
The warranty does not cover damage attributable to abnormal use of the product by the purchaser or to environmental conditions where the purchased goods are located, such as, by way of example but not limited to, high humidity in the room, overheating of the room, exceptional or unusual temperatures and weather conditions, or improper use by the purchaser, such as poor maintenance (cleaning with inappropriate products or means) or use that is not in accordance with the characteristics for which the item is intended.

The Seller does not guarantee that the colors shown on the website will perfectly match the original colors. This does not constitute grounds for a claim for non-conformity.
To exercise this right, the customer must document the non-conformities found by sending a registered letter with return receipt to: 'Stage Deck srls, Via Sandro Pertini snc 20152 MILAN' within the terms set out above, and, at our request, send any digital photos by email or, if necessary, at the seller's request, even arrange for the defective item to be shipped.
This will allow the Seller to determine whether the defect found is attributable to manufacturing problems (conformity defects), in which case the defective material will be repaired or the defective part replaced, or alternatively replaced upon return of the defective item. If the Seller determines that the product has been misused by the customer, no free replacement will be provided.

After receiving such notification and/or documentation, the Seller shall, within 10 working days, communicate its decision to authorize or refuse the return of the defective material, sending by email a document to be attached to the goods to be returned. The material must be sent to the address that will be communicated.
The replacement will be made as soon as possible. The related transport costs for the replacement, both for the return of the goods and for the replacement, shall be borne by the Seller.

12 – RIGHT OF WITHDRAWAL –
Online sales are subject to Legislative Decree No. 206 of 06-09-2005, Articles 64/68, which provides for the possibility for consumers (i.e., a natural person who purchases goods for purposes not related to their professional activity, or who does not make the purchase by indicating a VAT number on the order form) to exercise their right of withdrawal. This right consists of the customer's right to withdraw from the purchase contract, return the purchased goods, and request a refund of the price paid without penalty and without giving any reason.
PLEASE NOTE: It will not be possible to exercise the right of withdrawal for products with special sizes and/or finishes made at the customer's request.
To exercise this right, it is necessary to:

1) send, within 10 days from the date of delivery of the goods by the courier or shipper, a registered letter with return receipt addressed to: 'Stage Deck srls, Via Sandro Pertini snc 20152 MILAN' – indicating the invoice number, code and quantity of items, and bank details for the transfer.

2) wait for approval via email, which will include a return document and the name of the courier who will collect the goods. The customer undertakes and agrees to return the product(s) to 'Stage Deck srls, Via Sandro Pertini snc 20152 MILAN' no later than ten working days from the date of approval issued by the Seller to the address provided.

3) Products must be returned intact, unused, unaltered, unstained, unwet, and undamaged;
Products must be returned in their original packaging, complete with all parts. The packaging must be intact, undamaged, unwet, and unaltered in any way;
Products must be returned in a single shipment. The Seller reserves the right not to accept products from the same order that are returned and shipped at different times;

4) If all the required conditions are met, and after the Seller has received the return and checked that all requirements have been met, an email confirming acceptance of the return will be sent. The refund will be made as quickly as possible, and in any case within thirty days from the date on which the Seller became aware of the exercise of the right of withdrawal, once it has been verified that the withdrawal took place in compliance with the above conditions. It is not possible to exchange the model of the product for which the right of withdrawal is exercised for another.
If the terms and conditions for exercising the right of withdrawal, as specified in this paragraph 12, are not met, the right to a refund of sums already paid cannot be exercised; however, it is possible to obtain, at the customer's expense, the products in the condition in which they were returned to the Seller. In the event of exercising the right of withdrawal, the refund of the sums paid will be made by the Seller to the person who made the payment.

The costs incurred for returning the products, without exception, are entirely borne by the customer.

5) We do not accept returns of goods paid for by cash on delivery.

6) After checking that all the above conditions have been met and that the condition of the product(s) and packaging is as agreed, the Seller will deduct the costs incurred for returning the goods and credit the products at the price indicated on the invoice within 30 days of receiving the goods.
Pursuant to Article 5, paragraph 3 of the aforementioned Legislative Decree, the right of withdrawal cannot be exercised in the case of the supply of goods that are made to measure or clearly personalized.

Please note: this right is reserved solely for natural persons (consumers), and therefore cannot be exercised by legal entities or natural persons acting for purposes related to any business or professional activity they may carry out and who purchase with a VAT number.

13 – INFORMATION ON THE PROCESSING OF PERSONAL DATA –
Pursuant to and for the purposes of Article 13 of Legislative Decree No. 196/2003, we hereby inform you of the following:

  1. a) Personal data voluntarily provided when completing the registration or order form will be processed, including through the use of computerized and telematic procedures on databases, for management, statistical, commercial, promotional, and advertising purposes relating to products and services offered by Stage Deck srls, Via Sandro Pertini snc, 20152 MILAN.
  2. b) The acquisition of personal data is optional; however, any refusal to respond or give consent may make it impossible for 'Stage Deck srls, Via Sandro Pertini snc 20152 MILAN' to follow up on the user's requests.
  3. c) the personal data provided may be communicated and disclosed for all the purposes indicated above in letter a) of this policy, including to other companies belonging to the group of 'Stage Deck srls, Via Sandro Pertini snc, 20152 MILAN'.
  4. d) The personal data provided may be processed for the purposes referred to in point a) of this policy, including by the following means: fax, telephone, even without operator assistance, email, and other computerized and/or automated communication systems.
  5. e) in relation to the aforementioned processing, the subject to whom the personal data refers has the right at any time to obtain confirmation of the existence or otherwise of such data and to know its content and origin, verify its accuracy or request its integration or updating, or correction pursuant to Art. 7 of Legislative Decree No. 196/2003. Pursuant to the same article, the data subject has the right to request the deletion, transformation into anonymous form, or blocking of data concerning him/her, even if pertinent to the purpose of collection or for the purpose of sending advertising or direct sales material or for carrying out market research or commercial communication.
  6. f) the data controller is ‘Stage Deck srls, Via Sandro Pertini snc, 20152 MILAN’
  7. g) The personal data provided will be stored at the offices of Stage Deck srls, Via Sandro Pertini snc 20152 MILAN.
  8. h) The personal data provided may be transferred abroad, within the European Union, in accordance with and within the limits set out in Article 42 of Legislative Decree No. 196/2003. Personal data may be transferred abroad to countries outside the EU within the scope and limits set out in Article 44(B) of Legislative Decree No. 196/2003.

14 – APPLICABLE LAW –
Unless expressly agreed otherwise, the provisions of Italian law and the Civil Code and Legislative Decree No. 205/06 (the Consumer Code) shall apply.

15 – JURISDICTION –
Any dispute relating to the application, execution, interpretation, and violation of the online purchase rules established by 'Stage Deck srls, Via Sandro Pertini snc, 20152 MILAN' is subject to Italian jurisdiction.
If the customer is a "consumer," any dispute relating to the interpretation and execution of the purchase rules shall be subject to the jurisdiction of the court in the district where the "consumer" customer resides.
If the customer is a "non-consumer," i.e., purchasing with a VAT number, the parties expressly agree that any dispute relating to the interpretation and execution of the purchase rules shall be subject to the exclusive jurisdiction of the Court of Milan.
